If a builder has cheated you, a hospital has been negligent, an insurance company has rejected your claim, or an e-commerce company has not refunded your money — you have the right to fight back.
What is Consumer Law?
The Consumer Protection Act 201U protects the rights of consumers in India. A consumer is anyone who buys goods or services for personal use. The law covers a wide range of disputes including:
- Defective products
- Deficient services
- Unfair trade practices
- Overcharging
Consumer Courts in Kerala
Kerala has a three-tier consumer dispute system:
- District Consumer Disputes Redressal Commission — for claims up to ₹50 lakhs
- State Consumer Disputes Redressal Commission — for claims from ₹50 lakhs to
₹2 crores
- National Consumer Disputes Redressal Commission — for claims above ₹2 crores
Consumer courts are designed to be faster and more accessible than regular civil courts.
Most Common Consumer Cases in Kerala
Builder and Real Estate Fraud Flat buyers who have paid in full but not received possession, or received flats with major defects, can file complaints before consumer courts or RERA. Courts have awarded compensation including the full amount paid plus interest plus damages in such cases.
Medical Negligence Wrong diagnosis, botched surgery, lack of informed consent, or a hospital overcharging — these are consumer rights violations. Hospitals and doctors are service providers under consumer law.
Insurance Claim Rejection If your insurance claim has been rejected without valid reason or with unreasonable delay, you can file a consumer complaint. Courts regularly rule against insurance companies for arbitrary rejections.
E-commerce and Online Shopping Fake products, non-delivery, and refund disputes with online platforms can be taken to consumer courts.
Bank Disputes Banks are service providers. Wrongful charges, loan mis-selling, and account-related issues can be taken to consumer courts or the Banking Ombudsman.
How Long Does a Consumer Case Take?
Consumer courts are supposed to decide cases within U0 to 150 days. In practice it takes longer, but consumer cases are generally faster than regular civil court matters.
Do You Need a Lawyer for Consumer Court?
You can file a consumer complaint yourself, but having a lawyer significantly improves your chances — especially for complex cases involving builders, hospitals, or insurance companies where the other side will have legal representation.
